Terms of Service

1. Acceptance of Terms

By creating an account or using The Memory Palace ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is operated by The Memory Palace, based in Leuven, Belgium. These Terms are governed by Belgian law and the laws of the European Union.

2. Account Responsibilities

To use the Service, you must:

• Be at least 16 years of age.
• Provide accurate and complete registration information.
• Keep your login credentials secure and confidential.
• Notify us immediately at privacy@thememorypalace.ai if you suspect unauthorized access to your account.

You are responsible for all activity that occurs under your account. We are not liable for losses arising from unauthorized use of your account.

3. Acceptable Use

You agree not to use the Service to:

• Upload, store, or share content that is illegal, abusive, defamatory, or infringes on the rights of others.
• Distribute malware, viruses, or any harmful code through the platform.
• Attempt to gain unauthorized access to other users' accounts, data, or any part of our infrastructure.
• Use automated tools (bots, scrapers) to access the Service without our written permission.
• Use the Service for commercial purposes without our prior consent.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

There is zero tolerance for objectionable content or abusive behavior toward other users. The Service lets you report content and block users directly from comments, profiles, and shared palaces. We review every report and will remove violating content and eject offending users within 24 hours.

4. Your Content & Intellectual Property

You retain full ownership of all content you upload to The Memory Palace, including photos, videos, text, and audio recordings ("Your Content").

By uploading content, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you and any users you explicitly share it with.

When someone without an account sends something through a member's link (a memory, a name on a photo or an answer to a question), that person stays the owner. They give the member and us the right to keep the contribution and show it in that member's palace, for as long as the member keeps it. The member can always delete it. Anyone who wants their contribution removed can write to us through the contact page.

We do not claim any ownership over Your Content. We will not use Your Content for advertising, training AI models, or any purpose other than delivering the Service.

If someone else appears in a photo or a story you share, that sharing is your decision and your responsibility. You confirm that you have the right to share that content with the people you invite, and that you will respect an objection from the person concerned. We only store and show what you give us, to the people you name.

5. Service Availability

We strive to keep The Memory Palace available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We may modify, suspend, or discontinue features of the Service at any time. In the event of a permanent shutdown, we will provide at least 90 days' notice and a way to export your data.

6. Limitation of Liability

To the maximum extent permitted by applicable law, The Memory Palace and its officers, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, profits, or goodwill arising from your use of the Service.
• Any unauthorized access to or alteration of your content or data.

Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under mandatory law, including mandatory consumer protection law.

7. Indemnification

You agree to indemnify and hold harmless The Memory Palace from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

8. Termination

You may delete your account at any time through the Settings page. Upon deletion, all your data will be permanently removed immediately.

We may terminate or suspend your account if you violate these Terms. In cases of severe or repeated violations, termination may be immediate and without notice.

Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice within the application at least 30 days before they take effect.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and delete your account.

10. Governing Law & Disputes

These Terms are governed by the laws of Belgium. Any disputes arising from these Terms or your use of the Service shall be submitted to the courts of Belgium.

12. Subscriptions & Billing

Paid subscriptions renew automatically each year at the then-current rate until you cancel. We remind you by email before your subscription renews.

You can cancel at any time via Settings › Subscription. Your access continues until the end of the paid period; after cancellation you will not be charged again. After the first year you can cancel monthly: your subscription then ends at the end of the following month and we refund the rest.

New subscriptions may include a free trial of the duration stated at sign-up. The trial ends automatically.

If you are a consumer in the EU, you have a statutory 14-day right of withdrawal for purchases made through our website. By starting your subscription you request immediate performance of the service; if you withdraw within those 14 days, we refund the amount paid minus a pro-rata share for the period already used.

Purchases made through the Apple App Store are handled by Apple under Apple's own terms and payment conditions, including refunds. You manage or cancel App Store subscriptions through your Apple ID subscription settings.

13. Reporting illegal content

If you come across content in someone else's palace that you believe is illegal, you can report it to us at privacy@thememorypalace.ai. Tell us where the content is, exactly which content you mean, why you believe it is illegal, and how we can reach you. A report may also be anonymous, but then we cannot tell you what we decide.

We confirm your report, assess it carefully and not arbitrarily, and let you know what we decide. If we remove content or restrict access to it, we also tell the person who posted it why, and which routes are open to contest that, with us or before a court.

The same address is our point of contact for users and for the authorities of the Member States, the European Commission and the European Board for Digital Services. We correspond in Dutch and in English.

14. Death of a user and Legacy

In the Legacy settings you can name legacy contacts, choose what each of them may see (your whole palace, specific wings or specific rooms) and leave letters for them. If you have not signed in for the number of months you chose, we first ask the trusted person you named to confirm. Only after that confirmation do your contacts get access, and only to what you chose.

If you have not set up a legacy plan, your palace stays private. Next of kin can contact us at privacy@thememorypalace.ai with a death certificate and proof that they are an heir or the executor. We then provide a one-time export of the palace; nobody gets to sign in to the account. Heirs can also ask us to delete the account.

A paid subscription ends once we are notified of the death: it is not renewed, and we refund the unused part of the paid period to the estate. Subscriptions bought through the Apple App Store are handled by Apple; heirs can ask Apple to cancel and refund them.
